1. Acceptance of Terms

By downloading, installing, or using My Daily Bread ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

2. Description of Service

My Daily Bread is a Christian devotional mobile application, rooted in Catholic tradition, that provides:

• Guided devotionals reflecting on the liturgical readings, following the Catholic lectionary cycle
• Daily devotional reflections
• Traditional Christian prayers and prayer resources
• Bible reading with progress tracking
• Spiritual growth tools and features

The App is provided as-is and we reserve the right to modify, suspend, or discontinue any feature at any time without notice.

3. Age Requirements and Parental Consent

The App is designed for users of all ages. However:

• Users under 13 must have verifiable parental or guardian consent to create an account
• Users between 13-17 should obtain parental permission before using the App
• By creating an account for a child, parents/guardians accept these Terms on the child's behalf and are responsible for the child's use of the App

4. User Accounts

4.1 Account Creation

You may create an account using email, Google Sign-In, or Apple Sign-In. When you create an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Not impersonate any person or entity
• Not create multiple accounts
• Not share your account with others

4.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use or security breach

We are not liable for any loss or damage arising from your failure to protect your account credentials.

5. Acceptable Use

You agree to use the App only for lawful purposes and in a manner consistent with the App's spiritual and devotional purpose.

5.1 Prohibited Activities

You agree NOT to:

• Use the App in any way that violates any applicable law or regulation
• Attempt to gain unauthorized access to the App, accounts, systems, or networks
• Interfere with, disrupt, or create an undue burden on the App's servers or networks
• Use automated systems, bots, or scraping tools to access the App without permission
• Impersonate any person or entity, or falsely state or misrepresent your affiliation
• Share content that is offensive, inappropriate, harmful, or disrespectful to the Christian faith
• Upload viruses, malware, or any malicious code
• Reverse engineer, decompile, or attempt to extract source code from the App
• Use the App for any commercial purpose without our written consent
• Collect or harvest any personally identifiable information from the App
• Circumvent, disable, or interfere with security features or usage limits

5.2 Enforcement

We reserve the right to investigate and take appropriate action against anyone who violates these Terms, including removing content, suspending or terminating accounts, and reporting to law enforcement authorities.

6. Intellectual Property

6.1 Our Rights

The App and its original content, features, and functionality (including but not limited to software, text, images, graphics, logos, and design) are owned by My Daily Bread and are protected by international copyright, trademark, patent, and other intellectual property laws.

6.2 Content Attribution

• Bible Text: Douay-Rheims Bible (Challoner Revision, 18th century), a public domain English translation of Scripture. This translation is free from copyright restrictions.
• Liturgical Readings: Our devotionals reflect on and summarize the Catholic liturgical readings but do not reproduce copyrighted texts from the USCCB or other modern translations.
• Traditional Christian Prayers: Public domain works including the Rosary, Divine Mercy Chaplet, and traditional Catholic prayers.
• Devotional Content & Reflections: Original works copyrighted by My Daily Bread (© 2025 and beyond).
• App Design & Code: Proprietary software and design elements owned by My Daily Bread.

6.3 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms. This license does not permit you to:

• Modify, copy, or create derivative works based on the App
• Distribute, transmit, or sublicense the App to any third party
• Reverse engineer or access the App to build a competitive product
• Use the App in any unlawful manner or in violation of these Terms

6.4 Trademarks

"My Daily Bread" and related logos are trademarks of My Daily Bread. You may not use these marks without our prior written permission.

7. Donations and Payments

The App is supported through voluntary donations processed via Apple's In-App Purchase system. Donations are:

• Voluntary and non-refundable
• Processed securely through Apple's payment systems
• Subject to Apple's refund policies
• Used to support app development and maintenance

All features of the App are available free of charge. Donations do not unlock additional features.

We are committed to keeping the App donation-supported and accessible to all. However, as development costs and user needs evolve, we may need to reassess our business model in the future. Strong donation support from our community helps ensure we can maintain a free, donation-only model without introducing paid features or subscriptions. We will provide advance notice if any changes to our business model become necessary.

8. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

THE APP AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that:

• The App will be uninterrupted, secure, or error-free
• Defects or errors will be corrected
• The App is free of viruses, malware, or other harmful components
• Results from using the App will meet your expectations or requirements
• The accuracy, reliability, or completeness of any content in the App
• Your data will be backed up or never lost

Some jurisdictions do not allow the exclusion of certain warranties. In such jurisdictions, some of the above exclusions may not apply to you.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

MY DAILY BREAD, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, revenue, or business opportunities
• Loss of data or information
• Loss of goodwill or reputation
• Business interruption
• Personal injury or emotional distress
• Any other intangible losses

This limitation applies whether the liability arises from:

• Your use or inability to use the App
• Any unauthorized access to, alteration of, or deletion of your data
• Any interruption, suspension, or cessation of the App
• Any bugs, viruses, trojan horses, or other harmful code transmitted through the App
• Any errors, omissions, or inaccuracies in content
• Third-party conduct or content on or through the App
• Any other matter relating to the App

LIABILITY CAP: In jurisdictions that do not allow the exclusion or limitation of liability for consequential or incidental damages, our liability is limited to the maximum extent permitted by law. In no event shall our total liability to you for all damages, losses, and causes of action exceed the amount you paid us in the twelve (12) months prior to the claim (or $100 USD if you have not made any payments).

Some jurisdictions do not allow certain limitations of liability. In such jurisdictions, some of the above limitations may not apply to you.

10. Spiritual Guidance Disclaimer

The App provides devotional content and spiritual resources for personal enrichment and spiritual growth. It is NOT a substitute for:

• Personal worship and participation in your faith community
• Personal spiritual direction from a pastor, priest, or spiritual advisor
• Professional mental health counseling or therapy
• Medical advice, diagnosis, or treatment
• Professional legal, financial, or other advice

For serious spiritual, mental health, medical, or other concerns, please seek appropriate professional guidance. We make no claims that the App can cure, treat, or prevent any condition.

11. Account Termination

11.1 Termination by You

You may delete your account at any time through the app settings. Upon deletion:

• Your access to the App will immediately cease
• All personal data will be permanently deleted within 30 days
• This action is irreversible
• Any donations made are non-refundable (subject to Apple's refund policies)

11.2 Termination by Us

We reserve the right to suspend or terminate your account and access to the App, without prior notice or liability, for any reason, including but not limited to:

• Breach of these Terms
• Violation of applicable laws or regulations
• Fraudulent, abusive, or illegal activity
• Requests from law enforcement or government agencies
• Extended inactivity (after 24 months with prior notice)
• Discontinuation or material modification of the App

11.3 Effect of Termination

Upon termination for any reason:

• Your right to use the App immediately ceases
• Your account and data may be deleted
• We are not liable for any loss resulting from termination
• Sections of these Terms that should reasonably survive will continue to apply (including intellectual property rights, disclaimers, limitations of liability, and dispute resolution)

12. Dispute Resolution and Arbitration

12.1 Informal Resolution

Before filing any formal dispute, you agree to first contact us at TODO-UPDATE-BEFORE-RELEASE@example.com to attempt to resolve the matter informally. We will attempt to resolve the dispute within 60 days.

12.2 Binding Arbitration

If informal resolution is unsuccessful, you agree that any dispute, claim, or controversy arising out of or relating to these Terms or the App shall be resolved through binding arbitration, rather than in court, except that:

• You may assert claims in small claims court if your claims qualify
• You or we may seek equitable relief in court for infringement or misuse of intellectual property rights

12.3 Class Action Waiver

YOU AND MY DAILY BREAD AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Unless both you and we agree otherwise, the arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.

12.4 Arbitration Rules

Any arbitration will be conducted by a neutral arbitration provider under its applicable rules. The arbitrator's decision will be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.

12.5 Opt-Out

You have the right to opt out of binding arbitration within 30 days of first accepting these Terms by sending written notice to TODO-UPDATE-BEFORE-RELEASE@example.com with the subject "Arbitration Opt-Out."

13. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting the updated Terms in the App and on our website.

How We Notify You: For material changes, we will notify users via email or in-app notification at least 30 days before the changes take effect.

Your continued use of the App after changes take effect constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using the App and delete your account.

14. Indemnification

You agree to defend, indemnify, and hold harmless My Daily Bread, its affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from or relating to:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any rights of another person or entity
• Your violation of any applicable laws or regulations
• Any content you submit or share through the App

We reserve the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, at your expense.

15. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of [TODO: INSERT STATE], without regard to conflict of law provisions.

Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in [TODO: INSERT JURISDICTION], and you irrevocably consent to personal jurisdiction and venue in such courts.

16. Miscellaneous

16.1 Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices or policies published by us in the App, constitute the entire agreement between you and My Daily Bread regarding the use of the App and supersede all prior agreements and understandings, whether written or oral.

16.2 Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.

16.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. Any waiver must be in writing and signed by an authorized representative of My Daily Bread.

16.4 Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction. Any attempted transfer or assignment in violation hereof shall be null and void.

16.5 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.

16.6 Apple-Specific Terms

If you downloaded the App from the Apple App Store, you acknowledge and agree that:

• These Terms are between you and My Daily Bread only, not with Apple Inc. ("Apple")
• Apple has no obligation to furnish maintenance and support services for the App
• Apple is not responsible for addressing any claims relating to the App or your use of it
• Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right to enforce these Terms against you
